1. Who we are

This website, upbeatengine.com, is operated by Mr. Kuncharn Sawasdee, trading as Upbeat Studio / Upbeat Engine, Thailand ("Upbeat Engine", "we", "us"). By using this website or buying a product, you agree to these terms.

2. Products and licenses

Our software is licensed, not sold. The license agreement (EULA) shown when you install a product governs how you may use that product. If these terms and a product's EULA differ on the use of the software, the EULA applies.

3. Purchases

  • The price, currency and any taxes are shown at checkout before you pay.
  • Payment is handled by a third-party payment provider. Its name and terms are shown at checkout.
  • After payment you receive your license details by email.
  • Purchases made through the Apple App Store, the Microsoft Store or an authorized distributor are governed by the terms of that seller.

4. Trial versions

Trial versions let you evaluate a product before you buy. We encourage you to test a product in your own setup before purchasing.

5. Activation

A license is for use on one computer at a time unless your purchase or the product states otherwise. Activation and moving a license to another computer are described in the product's license documentation.

6. Refunds

Refunds for purchases made on this website are covered by our Refund Policy.

7. Using this website

  • Do not use the website unlawfully or try to disrupt or gain unauthorized access to it.
  • The website, product names, logos and content belong to us or our licensors. You may not copy or reuse them without permission.
  • Links to other websites (for example YouTube, Facebook or file-download services) are provided for convenience. We are not responsible for their content or policies.

8. Disclaimers and limits of liability

Our software is audio-processing software. It does not replace proper system design, gain structure, equipment configuration, monitoring or professional judgment, and we do not guarantee that it will work in every situation or with every system.

To the maximum extent permitted by law, our total liability relating to a product is limited to the amount you paid for that product in the 12 months before the event giving rise to the claim. This limit does not apply to liability that cannot lawfully be limited, such as liability for fraud, gross negligence, or death or personal injury. Your statutory consumer rights are not affected.

9. Changes

We may update these terms. The version published on this page, with its "last updated" date, is the current version.

10. Governing law

These terms are governed by the laws of the Kingdom of Thailand. Disputes are subject to the competent Thai courts, except where mandatory consumer-protection law provides otherwise.
